1. Agreement
These Terms of Use (“Terms”) are an agreement between you and Match Medic Sağlık Yazılım ve Bilişim Anonim Şirketi (“Match Medic”, “we”, “us”), a company established in the Republic of Türkiye, about your use of the Lume: Alarm Clock to Wake Up Early app (“Lume” or the “App”) and this website. By downloading or using Lume you accept these Terms and our Privacy Policy. If you don’t agree, don’t use Lume.
2. Who can use Lume
You must be at least 13 years old, and old enough to agree to these Terms where you live, or have a parent’s or guardian’s permission. If you use Lume for someone else, you are responsible for their use of it.
3. Your account
Some features need an account. Keep your sign-in details secure and tell us if you think someone else has used your account. You can delete your account at any time from Settings › Delete Account. Deleting your account does not cancel your subscription; see section 4.
4. Subscriptions, trials and payments
- Plans. Some features need a paid subscription. The current plans, prices and trial length are shown in the App before you buy and may differ by country and over time.
- Free trials. If you start a free trial, your subscription begins automatically at the end of the trial and you are charged unless you cancel at least 24 hours before the trial ends. Any unused part of a trial ends when you buy a subscription.
- Automatic renewal. Subscriptions renew automatically at the end of each period at the then-current price, and your Apple ID is charged within 24 hours before the period ends, unless you turn off auto-renew at least 24 hours before then.
- Cancelling. Manage or cancel in iOS Settings › your name › Subscriptions. Uninstalling Lume or deleting your account does not cancel. After cancelling, you keep access until the end of the paid period.
- Payments and refunds. Apple processes all payments, and Apple’s terms govern billing and refunds. To ask for a refund, go to reportaproblem.apple.com. We can’t issue refunds for App Store purchases ourselves. Nothing here limits refund or withdrawal rights you have under consumer law where you live.
- Price changes. If a subscription price goes up, Apple will notify you and, where required, ask for your consent before the new price applies.
- Offers. We may offer discounts or different trial lengths. Each offer applies only under the terms shown when it is made.
5. Alarm reliability
We work hard to make Lume ring on time and keep ringing until a mission is done. But an alarm depends on things we don’t control, including your iPhone’s battery, volume and settings, iOS updates, Focus modes, permissions you have granted, storage, and hardware faults. Missions that use the camera or microphone depend on lighting, positioning and background noise, and detection may sometimes fail or count incorrectly.
Do not rely on Lume as your only alarm for anything important, such as flights, exams, work shifts, medication or appointments. To the extent the law allows, we are not responsible for losses caused by an alarm that does not ring, rings late, cannot be stopped, or by a mission that cannot be completed.
If an alarm won’t stop when you need it to, you can always turn it off from your iPhone’s system controls or by force-quitting the App.
6. Mission safety
Some missions involve physical activity (squats, pushups, dancing), walking around your home, or having a drink. Lume is not a medical, fitness or nutrition service and does not give medical advice.
- Only choose missions that are safe for you. Talk to a doctor before starting physical activity if you have a health condition, injury or are pregnant, and stop if you feel pain, dizziness or shortness of breath.
- You are likely to be half-awake. Turn on a light, clear the floor, take care on stairs, and set up your phone somewhere stable.
- The energy drink mission is a fun way to get up, not a recommendation to drink caffeine. Follow product labels and choose the water mission if caffeine isn’t right for you. Don’t use this mission if you are under 18.
- Be mindful of other people in your home when using the camera, and of neighbours when your alarm is loud.
You use the missions at your own risk, to the extent the law allows.
7. Acceptable use
You agree not to:
- copy, modify, reverse engineer or resell Lume, except where the law allows this despite this restriction;
- get around subscription checks, security features or usage limits;
- use Lume to break any law or to record or monitor other people without their consent;
- interfere with Lume’s servers or other users’ use of the App;
- use automated tools to access Lume or extract its content.
8. Licence and intellectual property
We give you a personal, non-exclusive, non-transferable, revocable licence to use Lume on Apple devices you own or control, for your own non-commercial use, under these Terms and Apple’s Usage Rules. Lume, the Lume name, the rooster mascot, the alarm sounds, quiz content, designs and software belong to us or our licensors and are protected by intellectual property laws. These Terms don’t give you any rights to them other than the licence above.
9. Feedback
If you send us ideas, feature requests or other feedback, we may use them without owing you anything.
10. Third-party services
Lume uses services from Apple and other providers, such as payment processing, speech recognition, subscription management (RevenueCat), data storage and analytics (Google Firebase) and marketing attribution (AppsFlyer). Their own terms and privacy policies apply to them, and we are not responsible for them.
11. Disclaimers
To the extent the law allows, Lume is provided “as is” and “as available”, without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise that Lume will be uninterrupted, error-free or always detect missions correctly, or that it will change your sleep or wake-up habits.
Some places don’t allow these exclusions, so some may not apply to you. If you are a consumer, you keep all rights you have under mandatory consumer law.
12. Limitation of liability
To the extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunities, missed appointments or events, or lost data, arising from your use of or inability to use Lume. Our total liability for all claims relating to Lume is limited to the greater of the amount you paid us for Lume in the 12 months before the claim and USD 50.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
13. Termination
You can stop using Lume at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if we stop offering Lume. If we stop offering Lume while you have a paid subscription, we will give you reasonable notice. Sections that by their nature should continue after termination will continue.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Türkiye, and disputes will be heard by the courts and enforcement offices of İstanbul (Çağlayan). If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring a claim in your local courts. Before starting a formal dispute, please contact us so we can try to resolve it.
15. Apple App Store terms
If you downloaded Lume from Apple’s App Store:
- These Terms are between you and us, not Apple. We, not Apple, are responsible for Lume and its content.
- Your licence is limited to use on Apple-branded products you own or control, as allowed by the Usage Rules in the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for Lume.
- If Lume fails to meet any applicable warranty, you may tell Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for Lume.
- We, not Apple, are responsible for handling any claims about Lume, including product liability claims, claims that Lume fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If a third party claims Lume infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm you are not in a country subject to a US Government embargo or designated as “terrorist supporting”, and you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. Changes
We may update these Terms as Lume changes. We will change the date at the top and, for significant changes, tell you in the App before they take effect. If you keep using Lume after that, the updated Terms apply.
